Republic Act 11234 EVOSS (Energy Virtual One-Stop Shop Act) was signed by President Duterte last March 8, 2019, to the media. It aims to modernize and streamline the permitting process of power generation, transmission and distribution projects in the country. The "EVOSS" will be under by the Department of Energy. They will be the one in-charged on managing the EVOSS.
The Law mandates the creation of Energy Virtual One-Stop Shop Act (EVOSS) as an online system where prospective developers can apply, monitor, and receive all the needed permits and applications, submit all the documentary requirements and even pay for charges and fees as well. It also stated that all governments agencies involved will be required to follow a strict timeframe to act on pending applications.
The law stated…
"Failure of the mother agency and its attached bureaus, offices, and agencies, at both the national and local levels, including GOCCs [government-owned and controlled corporations], to release its action on applications duly filed with complete supporting documents within the prescribed timeframe shall deem such applications approved, ”..
As the law specified in setting an administrative sanction against government officials and as well as employees who will fail too act on the application of the law within the prescribed timeframe will have a corresponding fine including; willfully refuse to participate in the EVOSS, delay the operationalization of the EVOSS, and tamper with the EVOSS or any of its components.
For private entities who fail to act within the prescribed timeframe will be slapped with a P100,000.00 fine per day for every delay.
Implementing the EVOSS law needs initial funding of P 100 million. Even it is already signed by President Rodrigo Duterte, the initial funding budget needs to approve to start on operating and implementing the law.
